By accessing and using the services provided by Party Planners Australia ("we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to change these terms at any time without prior notice.

These Terms of Service govern your relationship with Party Planners Australia website and services operated by Party Planners Australia. These terms apply to all visitors, users, and others who access or use our services.

2. Description of Service

Party Planners Australia provides comprehensive event planning and coordination services including but not limited to wedding planning, corporate events, birthday parties, anniversary celebrations, and other special occasions throughout Australia. Our services encompass venue selection, vendor coordination, entertainment booking, catering arrangements, decoration planning, and event management.

We strive to deliver exceptional service quality and create memorable experiences for our clients. However, we reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

3. Service Agreement and Booking

All event planning services are subject to a written service agreement that outlines specific terms, conditions, and expectations for your event. A signed contract and deposit payment are required to secure our services for your event date. The deposit amount varies based on the scope and scale of your event.

Event dates are secured on a first-come, first-served basis upon receipt of signed contract and deposit. We recommend booking our services at least 3-6 months in advance for optimal planning and vendor availability, though we understand that some events may require shorter notice periods.

4. Payment Terms and Policies

Payment schedules are outlined in individual service agreements. Generally, a deposit of 25-50% is required upon contract signing, with the balance due 30 days prior to your event date. Additional charges may apply for services requested beyond the original scope of work.

Late payment fees of 1.5% per month may be applied to overdue balances. All payments must be made in Australian dollars. We accept various payment methods including bank transfers, credit cards, and certified checks. Refund policies vary based on the timing of cancellation and are detailed in individual service agreements.

5. Cancellation and Refund Policy

Cancellation policies are specific to each service agreement and depend on the timing of cancellation relative to your event date. Generally, cancellations made more than 90 days before the event may receive partial refunds, while cancellations made within 30 days of the event may forfeit all deposits and payments made.

In cases of force majeure events (including but not limited to natural disasters, government restrictions, venue closures, or other circumstances beyond our control), we will work with clients to reschedule events when possible. Refund terms for such situations will be handled on a case-by-case basis.

6. Client Responsibilities

Clients are responsible for providing accurate and timely information regarding event requirements, guest counts, dietary restrictions, and other relevant details. Changes to event specifications may result in additional charges and must be communicated in writing with reasonable advance notice.

Clients must ensure that all necessary permits, licenses, and approvals are obtained for their events. Clients are also responsible for the conduct of their guests and any damages caused during the event. We recommend obtaining appropriate event insurance coverage.

7. Limitation of Liability

Party Planners Australia's liability is limited to the total amount paid for our services. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

While we strive to coordinate all aspects of your event professionally, we are not responsible for the performance of third-party vendors, venue issues beyond our control, weather conditions, or other unforeseen circumstances that may affect your event.

8. Intellectual Property

All creative concepts, designs, and planning materials developed by Party Planners Australia remain our intellectual property. Clients may use these materials for their specific event but may not reproduce, distribute, or use them for commercial purposes without written permission.

We reserve the right to photograph and document events for portfolio and marketing purposes unless explicitly prohibited in writing by the client. Clients grant us permission to use event photos and testimonials for promotional purposes.

9. Privacy and Confidentiality

We respect your privacy and maintain confidentiality regarding your event details and personal information. Our privacy practices are detailed in our Privacy Policy, which forms part of these terms. We may share information with trusted vendors and partners as necessary to fulfill our service obligations.

Personal information collected during the planning process will be used solely for event coordination purposes and will not be shared with third parties without your consent, except as required by law.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the Australian courts. Both parties agree to attempt resolution through mediation before pursuing legal action.

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable. Our failure to enforce any right or provision will not constitute a waiver of such right or provision.
